Terms of Use

Rules governing access to and use of ScoutMe, including accounts, profiles, content, sports analysis, protection of minors, payments, moderation and responsibilities.

1. INTRODUCTION

Welcome to ScoutMe.

These Terms of Use ("Terms") govern access to and use of the ScoutMe platform, available through the website, progressive web application (PWA), applications, APIs and any other interfaces or services that may be made available by ScoutMe ("Platform").

The Platform is operated by [SCOUTME OPERATOR], a legal entity to be incorporated or otherwise defined, hereinafter referred to simply as "ScoutMe", "we", "us" or "Platform".

By creating an account, accessing or using ScoutMe, the user declares that they have read and understood these Terms and agree to comply with them.

When the user is a minor, the specific rules set out in these Terms for children and adolescents, as well as the legal requirements regarding participation by parents or legal guardians, also apply.


2. ABOUT SCOUTME

ScoutMe is a technology platform focused on the sports ecosystem, especially football, designed to facilitate the creation of sports profiles, the organisation and presentation of athlete information, the publication and analysis of videos and highlights, performance monitoring and connections between participants in the sports environment.

Among other features, ScoutMe may allow:

  • creation of sports profiles;
  • registration of personal and sports information;
  • inclusion of position, characteristics and sports history;
  • publication or linking of videos;
  • creation of highlights;
  • classification of sports events;
  • recording of physical and technical tests;
  • generation of performance indicators;
  • generation of attribute radars;
  • generation of overall scores;
  • generation of heatmaps;
  • presentation of statistics;
  • athlete search and discovery;
  • athlete tracking;
  • interaction between users;
  • contact between athletes and sports professionals;
  • creation of profiles for clubs, academies and organisations;
  • tools for scouts, coaches, agents, recruiters and sports organisations;
  • other features related to sports development, analysis, promotion and recruitment.

New features may be added, modified or removed as the Platform evolves.


3. USER PROFILES

ScoutMe may offer different account categories.

3.1. Athlete

A person who uses the Platform to create and maintain a sports profile, share information about their pathway and make content related to their performance available.

The profile may include, depending on the features made available:

  • name;
  • photograph;
  • age or date of birth;
  • nationality;
  • city and country;
  • height and weight;
  • position;
  • dominant foot;
  • club or team;
  • sports history;
  • videos;
  • highlights;
  • test results;
  • statistics;
  • attributes;
  • radar;
  • overall score;
  • heatmaps;
  • other sports information.

3.2. Minor athlete

Athletes under 18 years of age will be subject to additional protection procedures.

Depending on the athlete's age, applicable law and the features used, ScoutMe may require:

  • participation or authorisation by a legal guardian;
  • linking the athlete's account to a guardian account;
  • age verification;
  • guardian verification;
  • specific consents;
  • communication limitations;
  • restrictions on the exposure of information;
  • additional privacy settings.

ScoutMe may prevent or restrict certain features for minors whenever necessary for their safety or to comply with applicable law.


4. LEGAL GUARDIAN

Parents, guardians or other legally authorised representatives may create or manage accounts related to minor athletes.

The guardian represents that they have the legal authority to represent the minor.

When permitted by the Platform, the guardian may:

  • create or authorise creation of the account;
  • manage certain information;
  • monitor activities;
  • authorise publication of information;
  • manage privacy settings;
  • authorise use of images and videos where applicable;
  • request correction or deletion of information;
  • manage consents;
  • request account closure.

The guardian agrees to act at all times in the best interests of the child or adolescent.


5. SCOUTS

Users identified as scouts may use tools intended for athlete discovery and evaluation.

Depending on the plan subscribed to, they may:

  • search for athletes;
  • use filters;
  • view profiles;
  • follow athletes;
  • analyse videos and highlights;
  • review sports information;
  • create lists or favourites;
  • use evaluation tools;
  • contact users where permitted.

ScoutMe does not automatically certify a scout's professional qualifications unless a specific identification or verification is expressly indicated on the Platform.


6. COACHES AND TECHNICAL PROFESSIONALS

Coaches, fitness coaches, analysts, coordinators and other sports professionals may hold professional accounts.

These users are responsible for the accuracy of the professional information they provide.


7. CLUBS, TEAMS, ACADEMIES AND ORGANISATIONS

Clubs, teams, academies, football schools and other organisations may create institutional accounts.

A user who creates or manages an institutional account represents that they are authorised to act on behalf of the organisation.

ScoutMe may request documents to verify that authority.

Administrators of institutional accounts are responsible for actions carried out on behalf of the organisation within the Platform.


8. AGENTS, INTERMEDIARIES AND REPRESENTATIVES

Agents, intermediaries or sports representatives may use the Platform when this type of profile is available.

These professionals are solely responsible for:

  • their qualifications;
  • any professional registrations that may be required;
  • licences;
  • authorisations;
  • representation agreements;
  • compliance with the rules of federations, confederations and sports governing bodies.

Holding an account on ScoutMe does not constitute professional certification, licensing or endorsement by ScoutMe.


9. OTHER SPORTS PROFESSIONALS

ScoutMe may offer accounts to other participants in the sports ecosystem, including recruiters, analysts, sporting directors, coordinators, fitness coaches and related professionals.

Features and permissions may vary by profile type.


10. ACCOUNT CREATION

Certain features require creation of an account.

The user must provide truthful, complete and up-to-date information.

It is prohibited to:

  • create a false identity;
  • use another person's identity without authorisation;
  • falsify age;
  • falsify affiliation with clubs;
  • falsify sports history;
  • falsify professional qualifications;
  • use false documents;
  • create accounts intended to deceive other users.

ScoutMe may request additional verification where necessary to confirm identity, age, institutional affiliation or professional status.


11. ACCOUNT SECURITY

The user is responsible for keeping their access credentials secure.

The user must not share their password with third parties.

If unauthorised access is detected, the user must notify ScoutMe immediately.

ScoutMe may implement additional security mechanisms, including multi-factor authentication and device verification.


12. ATHLETE PROFILE

The sports profile is intended to present relevant information about the athlete.

The user is responsible for the accuracy of the information provided.

Sports information may originate from:

  1. the athlete directly;
  2. the legal guardian;
  3. authorised clubs or organisations;
  4. authorised professionals;
  5. data generated by ScoutMe analytical features.

Whenever possible, the Platform may identify the source of the information.


13. VIDEOS AND HIGHLIGHTS

ScoutMe may allow users to include, link, embed or display videos hosted by the user or by external services.

The user represents that they hold all rights, permissions or authorisations necessary to use the content.

This includes, where applicable:

  • the right to use the video;
  • image-use authorisation;
  • copyright permissions;
  • athlete authorisation;
  • legal guardian authorisation;
  • authorisation from the club or content producer.

Publishing content on ScoutMe does not transfer ownership of that content to ScoutMe.


14. CONTENT LICENCE

By publishing or making content available on the Platform, the user grants ScoutMe a non-exclusive licence limited to what is necessary to:

  • host or embed the content;
  • store it where necessary;
  • process it;
  • reproduce it technically;
  • display it to authorised users;
  • generate thumbnails;
  • perform analyses related to Platform features;
  • make the content available in accordance with the privacy settings selected.

This licence exists solely for the operation and provision of ScoutMe services and remains in force while the content is available on the Platform or for the period technically necessary to comply with legal obligations.


15. IMAGE RIGHTS

The user must hold the necessary authorisation to make images of third parties available.

For minor athletes, all legal requirements concerning image protection, privacy, dignity and the best interests of the child or adolescent must be observed.

ScoutMe may remove or restrict content where a legitimate question arises regarding image-use authorisation.


16. MATCH AND SPORTS EVENT CONTENT

A user's participation in a match does not necessarily mean that they own the broadcasting or reproduction rights to the footage.

The user is responsible for confirming that they have authorisation to use recordings originating from:

  • television broadcasts;
  • streaming services;
  • clubs;
  • competitions;
  • federations;
  • production companies;
  • photographers;
  • digital platforms;
  • third parties.

ScoutMe may remove content following a valid complaint concerning infringement of rights.


17. HIGHLIGHTS

A highlight represents a selected segment or sports event within a given video.

Highlights may contain information such as:

  • start and end times;
  • type of event;
  • situation;
  • field region or zone;
  • player involved;
  • supplementary information.

This information may be used by ScoutMe analytical mechanisms.


18. PERFORMANCE ANALYSIS

ScoutMe may use information provided by users to generate sports indicators.

These indicators may include:

  • technical attributes;
  • physical attributes;
  • radar;
  • overall score;
  • heatmap;
  • statistics;
  • indices;
  • classifications;
  • confidence indicators;
  • other analytical outputs.

Results are estimates produced using the methods and data available on the Platform.


19. LIMITATIONS OF ANALYSIS

Users acknowledge that sports analysis has limitations.

Results may vary according to:

  • number of videos;
  • number of highlights;
  • image quality;
  • events recorded;
  • match context;
  • athlete position;
  • amount of data available;
  • methodology used;
  • quality of the information entered.

A limited number of videos or events may not adequately represent an athlete's overall performance.


20. OVERALL SCORE AND RADAR

ScoutMe may calculate aggregated indicators, including attribute radars and an overall score.

These indicators:

  • do not constitute professional certification;
  • do not represent a guarantee of ability;
  • do not represent an official federation ranking;
  • do not guarantee recruitment;
  • do not guarantee selection;
  • do not guarantee future performance.

They are auxiliary tools for sports analysis.


21. PHYSICAL AND TECHNICAL TESTS

ScoutMe may allow physical or technical test results to be recorded.

Where results are entered by the user, guardian, coach or organisation, ScoutMe does not guarantee that the test was performed correctly.

The Platform may distinguish self-declared data from verified data.


22. NO GUARANTEE OF OPPORTUNITIES

ScoutMe is a technology platform for sports exposure, organisation, analysis and connection.

ScoutMe does not guarantee:

  • recruitment by clubs;
  • trials;
  • participation in tryouts;
  • sports scholarships;
  • professional contracts;
  • representation by agents;
  • call-ups;
  • transfers;
  • professional opportunities.

Sports decisions are made exclusively by the respective clubs, scouts, coaches, agents or other responsible parties.


23. NO EMPLOYMENT OR REPRESENTATION RELATIONSHIP

Use of ScoutMe does not create an:

  • employment;
  • corporate;
  • membership;
  • representation;
  • agency;
  • mandate;

relationship between ScoutMe and its users.

Likewise, an interaction between users does not automatically create a contractual relationship between them.


24. CONTACT BETWEEN USERS

Where available, the Platform may allow communication between users.

ScoutMe may apply different communication rules depending on the type and age of the user.

Communication tools must not be used for:

  • harassment;
  • intimidation;
  • unlawful discrimination;
  • threats;
  • fraud;
  • spam;
  • unlawful proposals;
  • improper collection of personal information;
  • exploitation of minors;
  • grooming;
  • sexual approaches;
  • any conduct that may place children or adolescents at risk.

25. COMMUNICATION WITH MINORS

Protecting children and adolescents is a priority requirement for ScoutMe.

The Platform may restrict or prevent direct communication between adults and minors.

Depending on the feature, contacts involving minor athletes may:

  • require guardian participation;
  • be directed to the guardian;
  • be recorded;
  • be subject to limitations;
  • depend on professional verification.

ScoutMe may immediately block accounts displaying conduct that may be dangerous to minors.


26. DATA OF MINORS

The processing of children's and adolescents' data will observe their best interests and applicable law.

ScoutMe may adopt differentiated privacy and security measures for minor accounts.

Certain information may be hidden or have restricted visibility.


27. LOCATION OF MINORS

Information that may pose a safety risk to minors may receive special treatment.

ScoutMe may restrict public exposure of:

  • precise location;
  • address;
  • school;
  • routines;
  • schedules;
  • telephone number;
  • personal email;
  • other information that could facilitate inappropriate location or contact.

28. PRIVACY

Processing of personal data by ScoutMe is also governed by the ScoutMe Privacy Policy, which must be read together with these Terms.

The Privacy Policy will specify, among other matters:

  • data collected;
  • purposes;
  • legal bases;
  • sharing;
  • retention;
  • security;
  • data subject rights;
  • processing of minors' data;
  • international transfers.

29. PROFILE VISIBILITY

The Platform may offer different visibility levels, such as:

Public: information broadly available.

ScoutMe users: information available only to authenticated users.

Verified professionals: certain information available only to authorised professional profiles.

Private: information accessible only to the user, guardian or authorised persons.

The options actually available will be presented on the Platform.


30. SENSITIVE PERSONAL DATA

Certain features may involve information classified by applicable law as sensitive personal data.

Where applicable, such data will be handled in a manner consistent with its nature and applicable legal requirements.


31. ATHLETE SEARCH AND DISCOVERY

ScoutMe may allow authorised users to search for athletes using sports-related criteria.

Filters may include information such as:

  • sport;
  • position;
  • age or sports category;
  • location at an appropriate level of detail;
  • sports characteristics;
  • attributes;
  • overall score;
  • test results;
  • tactical profile.

Filter availability will depend on permissions and privacy settings.


32. RANKINGS AND RECOMMENDATIONS

If ScoutMe provides rankings, recommendations or ordered results, these may use algorithms and criteria defined by the Platform.

These results do not represent a definitive evaluation of an athlete's quality.


33. ARTIFICIAL INTELLIGENCE AND AUTOMATION

ScoutMe may use algorithms, statistical models, artificial intelligence or other automated mechanisms for certain features.

Where applicable, these mechanisms may assist with:

  • classification;
  • organisation;
  • recommendations;
  • sports analysis;
  • moderation;
  • fraud detection;
  • security.

ScoutMe will seek to adopt appropriate measures for transparency and protection of user rights.


34. AUTOMATED DECISIONS

Where a decision based solely on automated processing produces relevant effects on a data subject, rights provided under applicable law will be observed.

The user may use the channels made available by ScoutMe to request information or exercise their rights.


35. FREE AND PAID PLANS

ScoutMe may offer free and paid features.

Plans may differ in relation to:

  • features;
  • storage;
  • number of videos;
  • number of analyses;
  • filters;
  • professional tools;
  • reports;
  • visibility;
  • other resources.

Commercial conditions will be presented before purchase.


36. PAYMENTS

Payments may be processed by specialised payment providers.

ScoutMe may not directly store full credit card details.

Prices, billing frequency, taxes and conditions will be disclosed at the time of purchase.


37. SUBSCRIPTIONS

Plans may be offered on a subscription basis.

Where automatic renewal applies, this condition will be disclosed before purchase.

The user may cancel renewal according to the options made available by the Platform and applicable legal rules.


38. CONSUMER RIGHTS

Where the relationship between the user and ScoutMe constitutes a consumer relationship, the rights guaranteed by Brazilian law, including the Brazilian Consumer Protection Code, will be respected.

Nothing in these Terms is intended to exclude any right that cannot lawfully be waived.


39. PROHIBITED CONTENT

It is prohibited to publish content that:

  • violates the law;
  • infringes copyright;
  • infringes image rights;
  • contains sexual material involving minors;
  • exploits children or adolescents;
  • encourages violence;
  • contains unlawful discriminatory speech;
  • exposes third-party personal data without authorisation;
  • involves fraud;
  • contains malware;
  • is misleading in purpose;
  • places minors at risk.

40. PROHIBITED CONDUCT

It is prohibited to:

  • access third-party accounts without authorisation;
  • attempt to bypass security systems;
  • exploit vulnerabilities;
  • perform unauthorised scraping;
  • automate mass collection of profiles;
  • sell databases obtained from ScoutMe;
  • use information for spam;
  • create fake profiles;
  • manipulate results;
  • enter false sports events;
  • falsify test results;
  • falsify professional affiliations;
  • attempt to deceive Platform algorithms;
  • use the Platform for unlawful purposes.

41. SCRAPING AND DATA EXTRACTION

Automated collection of information from ScoutMe without express authorisation is prohibited.

This includes the use of:

  • bots;
  • crawlers;
  • scrapers;
  • automated scripts;
  • mechanisms intended to build parallel databases.

Official APIs must be used when made available.


42. SCOUTME INTELLECTUAL PROPERTY

The following are protected under applicable law, as relevant:

  • ScoutMe trademark;
  • visual identity;
  • logos;
  • software;
  • code;
  • interfaces;
  • design;
  • database;
  • documentation;
  • algorithms;
  • analytical models;
  • methodology;
  • texts;
  • graphic elements.

These Terms do not transfer ScoutMe intellectual property rights to the user.


43. REPORTS

Users may report:

  • fake profiles;
  • inappropriate behaviour;
  • illegal content;
  • copyright infringement;
  • image-rights infringement;
  • harassment;
  • fraud;
  • conduct involving risk to minors.

ScoutMe may provide specific reporting tools.


44. MODERATION

ScoutMe may review content and conduct when necessary for:

  • security;
  • fraud prevention;
  • compliance with these Terms;
  • compliance with law;
  • protection of users;
  • protection of minors.

Moderation may use human and automated mechanisms.


45. CONTENT REMOVAL

ScoutMe may remove or restrict content where there is:

  • violation of these Terms;
  • violation of law;
  • risk to users;
  • intellectual property infringement;
  • image-rights infringement;
  • a court order;
  • an order from a competent authority;
  • a relevant risk to minors.

Where appropriate and legally permitted, the user may be informed of the measure taken.


46. ACCOUNT SUSPENSION AND TERMINATION

ScoutMe may suspend or terminate accounts in cases of:

  • fraud;
  • false information;
  • serious or repeated violation of these Terms;
  • abusive behaviour;
  • security threats;
  • exploitation of minors;
  • attempted intrusion;
  • judicial or administrative order.

Measures may be taken immediately where necessary to protect users.


47. USER-REQUESTED DELETION

The user may request closure of their account through the available mechanisms.

Certain data may continue to be stored for the period necessary to comply with legal obligations, prevent fraud, exercise rights or for other purposes permitted by law.


48. THIRD-PARTY SERVICES

ScoutMe may integrate third-party services, including:

  • hosting;
  • CDN;
  • video services;
  • payment gateways;
  • authentication services;
  • analytics services;
  • communication tools.

Use of these services may also be subject to their respective terms and policies.


49. EXTERNAL LINKS

The Platform may contain links to external websites or services.

ScoutMe does not necessarily control these services and is not responsible for third-party content or practices, subject to responsibilities imposed by law.


50. AVAILABILITY

ScoutMe will seek to keep the Platform available but does not guarantee uninterrupted operation.

Interruptions may occur due to:

  • maintenance;
  • updates;
  • third-party failures;
  • internet issues;
  • security incidents;
  • events beyond the Platform's reasonable control.

51. CHANGES TO FEATURES

ScoutMe may modify features to improve security, performance, experience or the operating model.

Material changes affecting user rights will be communicated where required or appropriate.


52. LIMITATION OF LIABILITY

To the extent permitted by law, ScoutMe will not be responsible for sports decisions made exclusively by third parties based on information available on the Platform.

Clubs, scouts, coaches, agents and other users must conduct their own assessments.

Nothing in this clause excludes liability that cannot lawfully be excluded.


53. RELATIONSHIPS BETWEEN USERS

ScoutMe is not automatically a party to contracts entered into between users.

Negotiations involving:

  • recruitment;
  • transfers;
  • representation;
  • trials;
  • scholarships;
  • sponsorships;
  • provision of services;

are the responsibility of the parties involved, unless ScoutMe expressly states that it is acting as a party or intermediary in a specific transaction.


54. SAFETY IN SPORTS OPPORTUNITIES

Users should exercise caution regarding invitations for:

  • trials;
  • assessments;
  • travel;
  • meetings;
  • payments;
  • sending documents.

For minors, any opportunity must involve their legal guardians.

ScoutMe recommends that users confirm the identity and legitimacy of the organisations and professionals involved.


55. PROHIBITION OF FRAUDULENT CHARGES

It is prohibited to use ScoutMe to request fraudulent payments in exchange for alleged:

  • places at clubs;
  • tryouts;
  • contracts;
  • trials;
  • scholarships;
  • call-ups;
  • guaranteed opportunities.

Suspected violations may result in immediate account suspension.


56. SPECIAL PROTECTION OF CHILDREN AND ADOLESCENTS

ScoutMe will apply the best-interests principle of the child or adolescent when designing and operating features that may be used by minors.

Measures may include:

  • protective settings by default;
  • parental controls;
  • communication restrictions;
  • reporting mechanisms;
  • age verification;
  • guardian verification;
  • location restrictions;
  • profile limitations;
  • security and moderation systems.

57. EXPLOITATION AND ABUSE OF MINORS

ScoutMe has zero tolerance for sexual exploitation, grooming or abuse of children and adolescents.

Suspicious content or behaviour may result in:

  • immediate removal;
  • preservation of records where legally appropriate;
  • account blocking;
  • notification to competent authorities where required by law.

58. ADVERTISING TO MINORS

If ScoutMe uses advertising, features intended for or accessible to minors must comply with applicable legal restrictions.

ScoutMe may establish stricter rules for advertising directed at children and adolescents.


59. COMMERCIAL USE OF ATHLETE DATA

ScoutMe does not authorise users to collect athlete data for the creation of external commercial databases without an appropriate legal basis and authorisation.

Professional access to information must occur within the purposes made available by the Platform.


60. INTERNATIONAL TRANSFERS

Because ScoutMe intends to enable international interaction, certain data may be processed or stored in other countries.

Where international transfer of personal data occurs, the mechanisms and requirements of applicable law will be observed.


61. INTERNATIONAL USERS

Users located outside Brazil may use the Platform where the service is available in their countries.

These users must also comply with applicable local law.

ScoutMe may create additional terms specific to certain jurisdictions.


62. CHANGES TO THESE TERMS

These Terms may be updated to reflect:

  • legal changes;
  • new features;
  • operational changes;
  • security requirements;
  • evolution of services.

Where changes are material, users will be informed by appropriate means.

Where required, renewed acceptance will be requested.


63. COMMUNICATIONS

ScoutMe may send communications related to:

  • account;
  • security;
  • changes to the Terms;
  • features;
  • payments;
  • opportunities;
  • Platform notifications.

Promotional communications may provide their own unsubscribe mechanisms.


64. APPLICABLE LAW

These Terms are governed by and interpreted in accordance with the laws of the Federative Republic of Brazil.

Potentially applicable rules include, depending on the circumstances:

  • Brazilian Civil Code;
  • Brazilian Consumer Protection Code;
  • Brazilian Civil Rights Framework for the Internet;
  • Brazilian General Data Protection Law – LGPD;
  • Brazilian Child and Adolescent Statute – ECA;
  • Digital Statute of the Child and Adolescent;
  • intellectual property laws;
  • other applicable Brazilian laws.

65. DISPUTE RESOLUTION

ScoutMe will seek to resolve complaints initially through its official support channels.

Nothing in these Terms restricts the right of consumers or data subjects to seek administrative authorities or the courts where applicable.


66. JURISDICTION

Where legally permitted, disputes relating to these Terms will be submitted to the competent court at the registered office of the ScoutMe operator.

In consumer relationships, applicable jurisdiction rules and consumer rights, including rules concerning venue, will be preserved.


67. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain valid and enforceable.


68. NO WAIVER

Failure by ScoutMe to immediately exercise any right does not constitute a waiver of that right.


69. SUPPLEMENTARY DOCUMENTS

These Terms should be interpreted together with other documents made available by ScoutMe, especially:

Privacy Policy;

Cookie Policy;

Community Guidelines;

Child and Adolescent Protection Policy;

Copyright and Image Rights Policy;

Commercial or Subscription Terms, where applicable.

In case of conflict, applicable law and the specific rule corresponding to the relevant feature will prevail.

71. ACCEPTANCE

By selecting the option corresponding to "I have read and accept the Terms of Use", creating an account or continuing to use the Platform after these Terms take effect, as permitted by law, the user expresses agreement with these conditions.

For accounts that require participation by a legal guardian, acceptance must follow the specific procedure made available by ScoutMe.


72. FINAL PROVISION
